TERMS AND CONDITIONS FOR ONLINE AND OFFLINE COURSES/SERVICES
These terms and conditions are part of Registration form. Signing Registration form shall be considered as signing below given terms and conditions. All students must go through terms & conditions before or at the timing of signing registration form and must receive a copy of it.
The enrolled students must follow the below mentioned terms & conditions of Captessar Aviation without any exceptions, failing which strict disciplinary & legal action will be taken including expulsion from the institute.
“Course Materials” means the information provided by Captessar Aviation to accompany a course provided as part of the Services in hard copy or electronic form.
“Fees” means the fees paid by you to Captessar Aviation for the Services.
“Intellectual Property Rights” means copyright, rights in or relating to databases, patent rights, performers’ rights, designs and registered designs, trademarks, rights in or relating to Confidential Information and other intellectual property rights (registered or unregistered) throughout the world.
“Online Course” means the delivery by us of an online course pursuant to which you learn course materials remotely.
“Services” means the provision of the Online Course and/or the Taught Course and/or the Course Materials together with such other services as agreed from time to time and purchased by you through the Website or by telephone.
“Taught Course” means a course taught by us in a classroom setting to which you attend in person.
“Captessar Aviation” means the private educational entity/ Private Tuition centre being run for the time being for the purpose of teaching aviation subjects or providing Aviation services.
“Website” means www.captessar.com or www.pilottraining.in
These terms and conditions apply to Services provided by Captessar Aviation.
- Students must abide by the rules and regulations of Captessar Aviation at all times.
- You shall be responsible for all costs you incur in connection with your attendance at any Taught Courses or your access onto any Online Course.
- Students will be allowed in a class for the duration prescribed for concerned subject. However, a student can be allowed to attend classes in next batch/ next dgca exam session/ airlines exam if he has not cleared his/her subject for which he joined last batch.
- Once registered, a student’s membership will be valid for 6 months from the date of joining or after he is qualified to appear in DGCA exams, whichever occurs later.
- In no case he/she will be allowed for third session.
- Normally duration of classes will be as given below:

- We have the right to expel students who breach rules on a regular basis; we operate on a 3-strike policy. Attaining a 3rd strike will result in immediate expulsion after consultation with parent or guardian. Captessar Aviation’s decision in such cases will be final and students will have no legal remedy against expulsion in such cases.
- Strikes can be implemented for actions such as (but not limited to) abuse towards staff, abuse towards peers, any form of bullying, any rude words spoken or written, damage to Centre’s property, failure to attend classes, being consistently late, not completing homework, consistently not bringing in materials.
- No online classes shall be conducted in last 10 days of a session so all students are required to attend offline classes so that important questions and topics can be completed with utmost privacy.
- Soft or hard copies of notes for students, shall be provided to all candidates. However confidential notes and questions shall be taught in class only that too with utmost privacy.
- Appropriate action shall be taken against a student if found guilty of cheating/ stealing/ confidential notes (for class purpose only) / books for which he/she is not authorised.
- Should a student cause any damage to the Centre’s property, parents or guardians are to be held responsible for compensation including full costs of repair.
- Students are responsible for their own wellbeing and must bring pack lunch (drinking water, fridge and microwave are available but only members of staff can operate).
- Students are expected to observe and act upon the lesson timetable and must attend all classes on time.
- Must enter and exit the Centre premises accordingly and sensibly to avoid disturbance to others.
- Workbooks, exercise books and task sheets given by the Centre are to be kept neat, tidy and presentable.
- Fee Payment:
- The Fees for the online or offline Services shall be as set out on the Website or as told to you over the telephone/counselling at the time you booked a seat.
- Fees is to be paid full in advance at the time of admission.
- Fee can be paid through online payment mode or demand draft.
- Students opting for the Installment Payment Scheme will have to pay the applicable installment charges as decided by the management. Installment charges will be immediately applicable once a student has taken admission.
- In case of instalments, failure to pay the fees on time may result in exclusion from classes.
- Fee Refund
- Fee will not be refunded once the batch has been started.
- Admission fee is non-refundable under any circumstances.
- If a student is expelled or leaves within 7 days, fee will be charged at a rate of Rs 5000 per day or equal to the full fee charged for the subject, whichever is less.
- Refund fee amount will be paid through account payee cheque only, in the favour of the student.
- Refund/Replacement requests made verbally, over telephone, e-mail or fax will not be valid or accepted.
- Student has to submit the refund/replacement application in person to the coordinator in the admission office. Only the student or parents can submit Fee Refund/Replacement application. Please note that, we do not accept the applications from any other person/relative/friend.
- The policy of fee refund or seat replacement is strictly according to the above mentioned terms and is not negotiable under any circumstances.
- If a student is expelled or leaves before the end of session the remaining fee is forfeited. The Centre will not refund remaining fees in such circumstances.
- If classes are cancelled fees will be fully refunded for concerned subjects, students will be notified of any cancellations.
- Compensation hours accumulated will not be accessible or refunded once a student is either withdrawn or expelled.
- Captessar Aviation does not and is not responsible for booking any examination with any professional body or examination board. It is your responsibility to ensure that you book prior to the relevant closing date any exam necessary that you wish to take and which may or may not be associated with the subject matter of the Services provided to you by Captessar Aviation.
- No claim may be brought more than one months after the last date on which the Services concerned have finished or ceased to be provided by us.
- Intellectual Property
- All Intellectual Property Rights in the Course Materials, Online Courses and the speeches made by trainers at the Taught Courses are, and remain, the intellectual property of Captessar Aviation, whether adapted, written for or customised for the Client or not.
- You are not authorised to:-
(i) copy, modify, reproduce, re-publish, sub-licence, sell, upload, broadcast, post, transmit or distribute any of the Course Materials without prior written permission;
(ii) record on video or audio tape, relay by videophone or other means the Online Course or Taught Course given
(iii) use the Course Materials in the provision of any other course or training whether given by us or any third party trainer;
(iv) remove any copyright or other notice of Fitch Learning Ltd on the Course Materials;
(v) modify, adapt, merge, translate, disassemble, decompile, reverse engineer (save to the extent permitted by law) any software forming part of the Online Courses.
Breach by you of this clause 23(b) shall allow us to immediately terminate these terms and conditions with you and cease to provide you with any Services, including but not limited to access to the Online Courses.
- General Conditions:
- Batch venue and timings are subjected to periodic changes, as per the availability of faculties and classrooms.
- Classes may be extended on weekdays, weekends and public holidays in order to complete the syllabus on time.
- Students are solely responsible for the safety of their vehicles, mobiles & other belongings. Captessar Aviation will not be responsible for any damage/theft of the belongings.
- Students should abide the sitting arrangements set by the management. Students are requested to maintain a decent dress code in the institute.
- Absenteeism:
Students must attend the classes and test series regularly in their assigned batches/timings as per the scheduled timetable only. Students will be solely responsible for their absenteeism from classes/test series. In case of absenteeism, permission to attend missed classes, in other batches, is subjected to the discretion of management and availability of seats, and it is not mandatory for the institute to provide the backup of missed classes. In case of absenteeism in the test/s, no separate question papers will be issued to the students.
Parents and guardians are expected to demonstrate their commitment to the education process by encouraging students and respecting our staff.
- Captessar Aviation consists of a pool of experienced faculties, the same subjects in online and offline mode; may be taught by different faculty members as per the availability
- All disputes shall be settled under jurisdiction of Rajasthan High Court, Jaipur.
- Captessar Aviation Tuition Centre reserves the right to amend the rules and regulations as and when necessary.
- Captessar Aviation is free to transfer its office/ classrooms to any city or town in India as per requirements.
- Unavoidable Circumstances:
Captessar Aviation shall not be liable and responsible for the completion of the classes and syllabus, in case of failure or delay in delivering the classes caused by or results from acts beyond our control including, but not limited to:
- Acts of God/natural disasters like fires, explosions, earthquakes, floods, storms, explosions, infestations, epidemics, pandemic etc.
- National or regional emergency.
- War, invasion, terrorist threats, riots or any other civil unrest.
- Order or law or any action/policy by any governmental authorities.
- Strikes, shortage of transportation facilities or any other industrial disturbances.
In such cases, refund/replacement/course validity/course curriculum and other policies may be revised by Captessar Aviation management considering the situation, and will be considered final and abiding to all.
